Terms and conditions of service

These terms and conditions are published in English and are complete and binding in this language. The same rules are also available in Polish.

1. General information and seller details

These Terms and Conditions set out the rules for using the Online Color Analysis service provided through the website analizakolorystyczna.app

2. Scope of the service

The service consists of preparing an individual online color analysis based on:

the answers given in the form,
the photos sent by the Customer.

The analysis combines automated color analysis, performed by our own image-analysis model, with a review by our team of colorists; it is not medical or dermatological advice.

The visualizations in the report, for example outfits and hair colors shown on your photo, are computer-generated images and are marked as such.

The result of the service is digital material (PDF) sent electronically.

The website also offers digital products, such as PDF files and ebooks. Their description and prices are shown before purchase. We deliver them electronically, to the email address given at purchase or as a file to download.

3. Ordering

An order is placed by:

filling in the form,
making an online payment.

Payments are handled by Stripe. The available payment methods are shown while placing the order; only the methods available in the payment form can be used.

Prices are given in Polish złoty (PLN) and are gross prices.

4. Performance of the order

The delivery time is set by the offer shown at the time of ordering. If the offer does not state a shorter period, we deliver the analysis within 14 business days from:

the payment being booked,
receipt of all the required information and photos.

If data or photos are missing, the delivery time may be extended.

5. Right of withdrawal

A consumer may withdraw from a contract concluded online within 14 days of its conclusion, without giving a reason, subject to the statutory exceptions described in the refund and withdrawal policy.

Starting the analysis does not by itself cause the loss of the right of withdrawal. For a service, this right may expire once the service has been performed in full, if the consumer had previously given express consent to the service being performed before the withdrawal period ends and acknowledged that the right is lost once the service has been performed in full.

The withdrawal statement can be sent to contact@analizakolorystyczna.app or by post to the seller’s address given above. How and when payments are refunded is described in the refund and withdrawal policy.

6. Complaints procedure

Complaints about the analysis, digital products, delivery of the file or payment are received and handled by the seller: MYMOBI Roman Barzyczak.

You can submit a complaint by email to contact@analizakolorystyczna.app or by post to: ul. Jana Dekerta 2B lok. 3, 30-703 Kraków, Poland. You can also use our previous address analizakolorystycznaonline@gmail.com.

To help us handle your request, please give:

the email address used at purchase and, if you know it, the order number or date;
a description of the problem and when you noticed it;
how you would like the matter to be resolved;
the email or postal address to which we should send the reply.

Attachments, such as a screenshot, are voluntary. We do not require a special form or a receipt. If we need more information, we will contact you; this does not extend the reply deadline.

We reply to a complaint within 14 calendar days of receiving it, by email or on paper, to the address you give. The reply contains our position and the reasons for it and, if the complaint is accepted, how and when it will be resolved. If we do not reply to a consumer’s complaint within this period, the complaint is deemed accepted.

If digital content or a digital service does not conform to the contract, the consumer may ask for it to be brought into conformity with the contract and, in the cases provided for in the Polish Consumer Rights Act, for a price reduction or withdrawal from the contract. Complaints are free of charge. Starting or completing the analysis does not exclude the right to complain.

The rules for refunding amounts due are described in the refund and withdrawal policy.

A consumer may also get free help and advice from the European Consumer Centre in her country of residence, part of the European Consumer Centres Network (ECC-Net), in a cross-border dispute with a seller based in Poland. We do not take part in, and are not obliged to take part in, dispute resolution proceedings before a consumer ADR body.

7. Liability

The color analysis is subjective and advisory in nature.

The service provider is not liable for purchasing or styling decisions made by the Customer on the basis of the analysis.

This does not limit the service provider’s statutory liability for the conformity of the service with the contract or the rights of the consumer.

8. Personal data

Personal data is processed by MYMOBI Roman Barzyczak. The controller’s details, the purposes and legal bases of processing and the user’s rights are described in the privacy policy.

9. Final provisions

These Terms and Conditions apply from the date of publication.

These Terms and Conditions are governed by Polish law, without prejudice to the mandatory provisions protecting consumers. A consumer keeps the protection of the mandatory provisions of the law of the country of her habitual residence (Article 6(2) of the Rome I Regulation). A consumer may also bring proceedings in the courts of the place where she is domiciled (Article 18 of the Brussels Ia Regulation).

The service provider reserves the right to amend these Terms and Conditions; amendments do not affect orders already placed.
